Welcome to Little Oak Toys! The terms "we", "us" and "our" refer to Little Oak Toys. Little Oak Toys operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Little Oak Toys is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 - ACCESS AND ELIGIBILITY

By agreeing to these Terms, you represent that you are at least 18 years of age (the age of legal capacity in Ireland). If you allow minor dependents to use the Services, you do so under your full responsibility and consent.

To complete a purchase, you must provide accurate billing, payment, and shipping information. You represent that you have the legal right to use any payment method provided. We process all personal data in accordance with the Data Protection Acts 1988–2018 and the GDPR.

SECTION 2 - OUR PRODUCTS AND STATUTORY RIGHTS

We make every effort to display product colors and images accurately. However, we cannot guarantee that your device’s display will be accurate.

SECTION 3 - ORDERS AND CONTRACT FORMATION

Your order constitutes an offer to purchase. A contract is only formed when we send you a Dispatch Confirmation email. We reserve the right to decline any order (e.g., due to pricing errors or stock unavailability).

Right of Withdrawal (Cooling-Off Period): As a consumer in the Republic of Ireland/EU, you generally have the right to cancel your order within 14 days of receiving your goods without giving a reason. Please refer to our Refund Policy for instructions on how to exercise this right and for details on return shipping costs.

SECTION 4 - PRICES AND BILLING

All prices displayed on our website are inclusive of VAT at the applicable Irish rate, unless stated otherwise. Prices do not include delivery charges, which are calculated at checkout.

We reserve the right to change prices at any time. The price applicable to your order will be the price displayed at the time you submit your order. You represent that the credit card or payment information provided is true and that you are authorized to use it.

SECTION 5 - SHIPPING AND DELIVERY

In accordance with Irish law, we will deliver goods without undue delay and no later than 30 days after the conclusion of the contract, unless a different delivery date has been agreed upon. Once the goods are delivered to you (or a person identified by you to take possession), the risk of loss or damage passes to you.

SECTION 6 - INTELLECTUAL PROPERTY

The Services and all original content (text, graphics, logos) are protected by Irish and International Copyright and Trademark laws. You are granted a limited license for personal, non-commercial use only. Any unauthorized reproduction or "scraping" of data is strictly prohibited.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

Little Oak Toys is powered by Shopify. You acknowledge that your contract for sale is with Little Oak Toys and not Shopify. Shopify is not responsible for the products, delivery, or any disputes arising from your purchase.

SECTION 9 - PRIVACY AND DATA PROTECTION

Your privacy is governed by our Privacy Policy. Because we are based in Ireland, we comply with the General Data Protection Regulation (GDPR). Your data may be processed by Shopify (as our processor) in accordance with their privacy standards to facilitate your transaction.

SECTION 10 - ERRORS AND OMISSIONS

Occasionally, there may be information on our site that contains typographical errors or inaccuracies regarding pricing or availability. We reserve the right to correct these and cancel orders if the information was materially incorrect, even after an order has been submitted.

In addition to other prohibitions, you are prohibited from using the site: (a) for any unlawful purpose; (b) to infringe upon our intellectual property; (c) to upload viruses or malicious code; (d) to use automated means (robots, spiders, or Agentic AI) to access the Services without our express identification protocols (see Section 12).

If you use an Agent (automated software) to interact with our Services:

1. The Agent must identify itself in the HTTP user-agent string as Agent/[name].

2. It must not attempt to bypass CAPTCHAs or mimic human behavior to circumvent security.

3. We reserve the right to block any Agent that causes excessive server load or violates these Terms.

SECTION 13 - LIMITATION OF LIABILITY

To the extent permitted by Irish law, Little Oak Toys shall not be liable for any indirect, incidental, or consequential damages. We do not exclude liability for death or personal injury caused by our negligence, or for fraud, or for any matter where it would be illegal to exclude liability under the Consumer Rights Act 2022.

You agree to indemnify Little Oak Toys against any claims or legal fees arising out of your breach of these Terms or your violation of any law or the rights of a third party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ireland.

You agree that the courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim arising out of these Terms. If you are a resident of the EU, you may also be entitled to use the European Commission's Online Dispute Resolution (ODR) platform.
